These Terms of Use ("Terms") govern your access to and use of the PermitWave pre-check tools and related services (the "Service"). By using the Service, you agree to these Terms.
If you do not agree with these Terms, please do not use the Service.
1. Description of the Service
PermitWave is an informational tool that helps users understand potential permit requirements for renovation and construction projects, mainly in municipalities in British Columbia. The Service provides a pre-check and intake experience only. It is not an official municipal application, approval system or legal service.
2. No professional or legal advice
The Service does not provide engineering, architectural, legal or other professional advice. Any guidance or information is general in nature and may not reflect the specific requirements for your project or jurisdiction.
You are responsible for confirming requirements with the applicable municipality and with qualified professionals where required by law or good practice.
3. Eligibility and responsibilities
By using the Service, you represent that you are capable of entering into a binding agreement in your jurisdiction, and that you will:
- Provide accurate and truthful information to the Service.
- Use the Service only for lawful purposes and in accordance with these Terms.
- Not misuse, reverse engineer or attempt to gain unauthorized access to any part of the Service.
4. Use of pre-check and intake results
Any result, indication or summary provided by the Service is preliminary and may be incomplete, outdated or inaccurate for your specific project. Municipal bylaws, codes and requirements change over time, and interpretations can differ.
You agree that you will not rely solely on the Service to decide whether a permit is required, what permit type applies, or what drawings or forms you must provide. Always verify requirements with the municipality and professionals as appropriate.
5. Ownership and allowed use
The Service, including all software, interfaces, text, graphics, logos and content, is owned or licensed by PermitWave and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to access and use the Service for your own internal purposes.
You may not copy, modify, distribute, host, sell or create derivative works based on the Service without our prior written consent, except as allowed by applicable law.
6. Third-party services and links
The Service may reference or link to third-party websites, tools or professionals. We do not control and are not responsible for the content, policies or services of those third parties. Your use of any third-party service is at your own risk and subject to their terms and policies.
7. Disclaimer of warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied or statutory. Without limiting the foregoing, we do not warrant that the Service will be accurate, complete, error-free, uninterrupted, secure or suitable for any particular purpose.
To the maximum extent permitted by law, we disclaim all implied warranties, including any warranties of merchantability, fitness for a particular purpose and non-infringement.
8. Limitation of liability
To the maximum extent permitted by law, PermitWave and its affiliates, officers, directors, employees and agents will not be liable for any indirect, incidental, consequential, special or exemplary damages, or for any loss of profits, revenues, data or business opportunities, arising out of or related to your use of the Service.
Our total liability for any claim related to the Service will be limited to the amount you paid (if any) for using the Service in the 3 months prior to the event giving rise to the claim, or a modest fixed amount where applicable law does not allow such limitation.
9. Changes, suspension and termination
We may update or change the Service at any time, including adding or removing features, and may suspend or terminate access to the Service for maintenance, security reasons or misuse.
We may also update these Terms from time to time. When we do, we will change the "Last updated" date below. Your continued use of the Service after changes become effective constitutes your acceptance of the updated Terms.

10. Governing law
These Terms are intended to be interpreted under the laws of the province of British Columbia and applicable laws of Canada, without regard to conflict-of-law principles, unless local law in your jurisdiction requires otherwise.
